Terms and Conditions

1. Scope

The General Terms and Conditions of Wortschmiede apply to the use of the content on the website http://www.wortschmiede.com and to the use of Wortschmiede’s services. The version of the General Terms and Conditions in force at the time the contract is concluded shall apply.

2. Services

Wortschmiede provides services relating to strategic word choice. Depending on the agreement, we assess the impact of words using qualitative and quantitative methods.

3. Orders

Following a consultation, the client agrees with Wortschmiede on the scope of the required services. The price is based on the effort involved, the scope and specifications of the surveys, and the duration of the consultancy period.

4. Contract

Following the consultation, the client will be sent a quotation, which they may accept within 7 days. Upon acceptance of the quotation, a contract is formed with Wortschmiede. The contract language is German.

5. Confidentiality

The services we provide, as well as the data collected and documents produced in this context, must not be disclosed. Clients are granted the exclusive and non-transferable right to use the data and documents. For its part, Wortschmiede shall not disclose the results of the consultancy to third parties. Likewise, Wortschmiede shall not disclose any documents that clients provide to Wortschmiede during the consultancy. This confidentiality shall remain in force even after the service has been completed.

6. Data protection

Any data stored by us when you use the website http://www.wortschmiede.com or avail of services provided by Wortschmiede will not be disclosed to third parties. Wortschmiede’s privacy policy applies.

7. Liability

Wortschmiede accepts no legal liability for the successful implementation of the advice provided.

8. Payment method

Payment is to be made by bank transfer to the Wortschmiede account. The agreed amount must be transferred to the following account within 7 days of receipt of the invoice:

In the event of late payment, a reminder fee of 10 EUR or 15 CHF will be charged for each reminder letter.

9. Place of jurisdiction

The place of jurisdiction is the District Court of 7000 Chur.

10. Defects and warranty

Any defects must be reported within 7 days of the order being completed. In such cases, Wortschmiede may be able to rectify the issue.

11. Cancellation of an order

If a contract is terminated before completion, the client must compensate Wortschmiede for work already carried out and any costs incurred in the process.

12. Arbitration clause

The contracting parties undertake, in the event of a disagreement, to engage in a conciliation procedure with the aim of reaching a fair and equitable agreement through mediation, with the assistance of a neutral conciliator, taking into account the economic, legal, personal and social circumstances.

13. Severability clause

Should any provision of these terms and conditions be invalid, this shall not affect the validity of the remaining provisions.
